Officers who must prove why they should stay on active duty have certain rights when a board of inquiry looks at their case. They must get written notice at least 30 days before the hearing that explains the reasons, be given a reasonable time to prepare, be allowed to appear in person and have a lawyer, and be given access to and copies of records that matter to the case. If a record is kept secret for national security, the officer must be given a summary when security allows it. In rare situations, the Secretary in charge may let the officer appear by other means instead of in person.
