Allows a reserve member who was allegedly sexually assaulted while on active duty to stay on active duty until officials finish deciding if the assault happened while the member was on duty, if the member asks and would otherwise be released. If the member was off active duty when the assault happened, the member can ask to be ordered back to active duty until that decision is done. The member must be told as soon as possible after the assault about this option. Each military department must make rules under Defense Department guidance. Any request must be decided within 30 days. If denied, the member can appeal to the first general or flag officer in their chain of command, and that appeal must be decided within 15 days. Line of duty determination — a decision about whether the assault occurred while the member was on active duty.
