The Secretary may buy group insurance from private companies instead of, or in addition to, using the Fund to provide the required benefits. To sell to the Secretary, a company must be licensed in all 50 States and the District of Columbia and, as of the most recent December 31 for which the Secretary has data, hold at least one percent of the total amount of that kind of insurance in the United States. A selling company must set up an administrative office where and under the name the Secretary chooses. The Secretary can use a company’s services, name one company to act for the others and pay it a reasonable fee, arrange approved reinsurance with other qualifying insurers that join, and cancel any purchased policy at any time.
