§12731b Special Rule for Members with Physical Disabilities Not Incurred in Line of Duty

Summary

The Secretary in charge can decide to treat a Selected Reserve member who only lost eligibility because they became unfit from a physical disability as if they met the service-year requirement, and give them the required notice, if the member has at least 15 and less than 20 years of service as counted under the law. The Secretary cannot give that notice if the disability was the result of the member’s intentional misconduct, willful neglect, or willful failure to follow retention rules, or if the disability happened while the member was absent without permission.
