Title 10 › Subtitle Subtitle E— Reserve Components › Part II— PERSONNEL GENERALLY › Chapter 1223— RETIRED PAY FOR NON-REGULAR SERVICE › § 12738
Once someone is granted retired pay, or is told they have the required years of service, their right to that pay cannot be taken away because of mistakes, wrong calculations, bad information, or administrative errors about their years of service — unless the person committed fraud or lied. If the years used to compute the pay are fixed, the retired pay is recalculated based on the corrected years starting from the date the pay was first granted.
