Title 10 › Subtitle A — General Military Law › PART I — ORGANIZATION AND GENERAL MILITARY POWERS › CHAPTER 3 — GENERAL POWERS AND FUNCTIONS › § 127f
Allows the Secretary of Defense to use money from Defense-wide operation and maintenance funds to prepare places for secret military operations and to build and keep special recovery capabilities to get U.S. military and civilian personnel (or others) back if they become isolated. The Secretary’s decisions about using the money are final for the government’s books, and the Secretary can approve payments without listing full details. In some special cases, the Secretary may give limited help—like gear, training, transport, supplies, or money—to foreign or irregular forces to help with these preparation and recovery tasks. The Secretary can spend up to $40,000,000 in a fiscal year for these purposes and cannot let someone else approve payments over $250,000. The Secretary must set rules for how this work is run, including policy, planning and coordination with other federal agencies, legal review, and keeping the congressional defense committees fully informed. The Assistant Secretary of Defense for Special Operations and Low Intensity Conflict is mainly in charge of oversight and must give quarterly briefings to those committees about activities and legal issues, and the Secretary must send an annual report by December 31 about prior-year spending that lists what was done, how much was spent, who got support, prior-year obligations, and other relevant details. This authority does not allow funding for intelligence or counterintelligence activities. Operational preparation of the environment = activities done in places where operations might happen to set conditions for missions.
