Title 10 › Subtitle Subtitle A— General Military Law › Part II— PERSONNEL › Chapter 69— RETIRED GRADE › § 1372
Unless another law gives a higher retired rank, a service member who retires for a physical disability or is placed on the temporary disability retired list gets the highest of a few possible ranks. These are: the rank they held on the day they entered the temporary list or retired; the highest temporary rank they served satisfactorily, as the service Secretary decides; the permanent regular or reserve rank they would have reached but for a disability found in a medical exam; or the temporary rank they would have reached but for that disability when that promotion depended on years of service or years in grade.
