Lets reserve officers in the Army or Air Force who are on the reserve active-status list and who hold the grades of first lieutenant, captain, major, or lieutenant colonel can be considered for promotion to the next grade when three things are true: they are filling or have been recommended for a position in the same competitive category that allows the higher grade, they meet all qualifications set by their Service Secretary, and they have held their current grade for the minimum time required by section 14303. Colonels and brigadier generals in the Army may be considered if they are assigned or recommended for duties at the next general-officer grade, have the minimum time in grade, and meet Army standards. Colonels and brigadier generals in the Air Force may be considered if assigned or recommended for the next general-officer duties and meet Air Force standards. A vacancy promotion board under section 14101(a) decides these promotions. If an officer is considered but not selected here, that does not count as a failed selection. An officer who failed selection under section 14501 can be considered or promoted under this rule only if the Service Secretary finds that the officer is the only qualified person to fill the vacancy, and that finding cannot be delegated.
