Summary
Starting October 1, 2008, if someone picks an annuity that cuts their retired or retainer pay, that pay cut must stop after whichever comes later: the 360th month the reduction has applied, or the month the person turns 70.

Effective October 1, 2008, a reduction under this subchapter in the retired or retainer pay of a person electing an annuity under this subchapter may not be made for any month after the later of— (1)
(2)the month during which that person attains 70 years of age.
