Title 10 › Subtitle Subtitle A— General Military Law › Part II— PERSONNEL › Chapter 73— ANNUITIES BASED ON RETIRED OR RETAINER PAY › Subchapter II— SURVIVOR BENEFIT PLAN › § 1453
The Secretary in charge can take back money that was paid by mistake by subtracting it from the person’s future payments. This can be used along with any other legal ways to recover the money. The Secretary does not have to take the money back if they find the person was not at fault and getting the money back would go against the program’s goals or would be unfair.
