During removal proceedings under this chapter, the military department’s Secretary can let an officer choose voluntary retirement, transfer to the Retired Reserve, or discharge if the officer meets the rules for those options. If an officer is removed, and they are eligible for voluntary retirement on that date, they must be retired at the rank and with the retired pay they would get. If they qualify for the Retired Reserve and have the years of service needed for retired pay under chapter 1223, they must be transferred there. If they are not eligible for retirement or transfer, they must be discharged in the rank they hold. If the case began under subsection (a) of section 14902 the discharge is honorable; if it began under subsection (b) of section 14902 it is a discharge. A discharged officer who qualifies may get separation pay under section 1174(c).
