When a Member of Congress asks, the military department secretary in charge must review a proposal to give an honorary promotion to a former or retired service member, alive or after death. The secretary decides whether the promotion has merit and then sends a written explanation of that decision to the Senate and House Armed Services Committees and to the Member who asked for it. If the secretary recommends approval, the Secretary of Defense may, under Defense rules, grant the honorary promotion up to the rank of major general or rear admiral (upper half). The Defense Secretary cannot do this until 60 days after the committees and requesting Member get the decision and the explanation. Any such promotion is honorary only and does not change pay, retired pay, or other government benefits for the person or anyone else. Member of Congress means a Senator or a Representative, Delegate, or Resident Commissioner.
