A federal court or a military judge can order a part of the Department of Defense that keeps DNA for identifying human remains to give those DNA samples to help investigate or prosecute a felony or any sexual offense when no other DNA source is reasonably available. The samples must be shared under the court’s terms and in a way that does not stop the Department of Defense from keeping the sample for identification of human remains.
