Title 10 › Subtitle A — General Military Law › PART II — PERSONNEL › CHAPTER 80 — MISCELLANEOUS INVESTIGATION REQUIREMENTS AND OTHER DUTIES › § 1566
Require the Secretary of Defense to write rules so each military service follows Defense Department directions on helping members vote. Voting assistance programs means the Federal Voting Assistance Program under the Uniformed and Overseas Citizens Absentee Voting Act and similar programs. Each service’s Inspector General must do one yearly check on how well voting help works and whether the service is following the rules. After those checks, each service IG sends a report to the Department of Defense IG. The DoD IG must send Congress a report by March 31 each year about how effective the programs were and how well each service complied during the prior calendar year. Secretaries of the military departments must include checking voting-law compliance in installation-level management reviews. Voting assistance officers must be appointed under DoD rules. Commanders must train and equip them, and performance reviews must note how they do this job. When possible, those officers must get time and resources to help people prepare and send absentee ballots before a general election. For the four months before a general Federal election month (November in even-numbered years), the Secretary of Defense must survey overseas sites, ships, and mail ports to find any voting materials and how long they’ve been held. Surveys are biweekly in the fourth and third months before the election and weekly in the second and first months. The Defense Department must move voting materials quickly and, when possible, give a postmark or proof of mailing but must not cause ballots to arrive after the election. Each military department must tell service members at each installation the last date an absentee ballot mailed from that installation can reasonably be expected to arrive on time. Secretaries must also make voter registration and absentee-ballot rules and deadlines easy to find by print and electronic media, give new enlistees the national voter registration form at enlistment or soon after, and, where practical, hold special days at installations to explain voting procedures.
