Title 10 › Subtitle Subtitle A— General Military Law › Part II— PERSONNEL › Chapter 81— CIVILIAN EMPLOYEES › § 1587a
The Secretary of Defense can limit the total pay for senior executives who work for nonappropriated fund organizations under DoD control. The aim is to make their total pay match what Department of Defense senior executives in the Senior Executive Service or other top DoD executive jobs receive. The Secretary must set rules for how to compare pay and must follow subsections (a) and (b) of 5 U.S.C. 5382 when doing so. The Secretary may act without following 5 U.S.C. 5373. Compensation includes the basic pay rate. “Senior Executive Service position” means the SES jobs defined in 5 U.S.C. 3132.
