Title 10 › Subtitle E — Reserve Components › PART IV — TRAINING FOR RESERVE COMPONENTS AND EDUCATIONAL ASSISTANCE PROGRAMS › CHAPTER 1606 — EDUCATIONAL ASSISTANCE FOR MEMBERS OF THE SELECTED RESERVE › § 16132a
A member of the Selected Reserve of the Ready Reserve who has at least six years of service and agrees to serve at least four more years (or meets other service rules set by the Secretary of Defense) can give some of their unused basic education benefits to their spouse, one or more children, or both. The member can transfer up to 36 months of benefits. The Secretary of Defense can set rules that require at least 18 months to be transferred. The member must name who will get the benefits, say how many months each gets, and say when the transfer starts. The member can change or cancel any unused part of a transfer at any time by sending written notice to their military service and the Department of Veterans Affairs. Transferred benefits are not marital property in a divorce. When a dependent uses a transferred month of benefits, one month is charged against the member’s total. Dependents follow the same benefit rules as the member and get the same monthly payment the member would receive. A spouse cannot start using transferred benefits until the member has completed at least six years of service (or meets rules set by the Secretary). A child cannot start using them until the member has completed at least ten years of service (or meets rules) and the child has finished high school or is 18. A child cannot use transferred benefits after turning 26. The dependent’s use keeps going if the member dies or is forced to separate or retire for certain reasons. If too much money is paid, the member and the dependent must repay it. The Secretary of Defense, with the Secretary of Veterans Affairs, will write the detailed rules.
