§20401 Applicability of Certain Provisions of Law Related to Separation

Summary

Most separation rules for regular officers in chapter 59 of title 10 apply to Space Force officers unless this section or other parts of the chapter change them. For enlisted Space Force members, sections 1169, 1170, 1171, 1173, 1174(b), and 1176(a) of chapter 59 apply, and the rules in section 1172 that cover someone enlisted under section 518 also apply. Rules in section 1174 are matched this way: rules for regular officers cover Space Force officers on sustained duty; rules for regular enlisted cover Space Force enlisted on sustained duty; rules for other members cover those not on sustained duty. Section 1175 about voluntary moves to a reserve covers voluntary release from active duty for Space Force members on sustained duty. Section 1176’s rules for regular enlisted apply to Space Force enlisted on sustained duty, and its rules for reserve enlisted on active status apply to Space Force enlisted in a space force active status or on sustained duty.
