The Secretary of Defense must get and run space systems mainly for space warfighting and control to meet needs set by one or more combatant commanders under section 164. The Secretary may also use commercial space systems to help, but only if a military leader responsible for space warfighting and control directs them. The Secretary may waive the buy-and-run requirement for national security reasons. If a waiver is used, the Secretary must notify the congressional defense committees within 10 days and explain the national security reason, the expected vulnerabilities, which operational commander will direct the commercial system, and how long the waiver will last.
