The Secretary of Defense, with the Secretary of State's agreement, may let the Department of Defense take part in programs that coordinate or swap air refueling and air transport services, including the ATARES program. Participation can be paid, swapped for equal value, or replaced with the same kind of service. DoD's net flight‑hour balance in ATARES may not exceed 500 hours total, and air‑refueling hours may not exceed 200. Such participation must be under a written agreement approved by both Secretaries. The Secretary of Defense may pay DoD's fair share of ongoing and one‑time program costs from operation and maintenance funds and may assign military or civilian personnel to carry out the agreement.
