Title 10 › Subtitle A — General Military Law › PART IV — SERVICE, SUPPLY, AND PROPERTY › CHAPTER 155 — ACCEPTANCE OF GIFTS AND SERVICES › § 2608
Allows the Secretary of Defense to accept gifts of money, real or personal property, and services (services only from foreign governments or international organizations) for use by the Department of Defense. Money and money from selling donated property go into a special Treasury account called the Defense Cooperation Account. Those funds can only be spent on authorized defense functions and only when Congress approves them in appropriation laws. Donated property can be kept as given, sold or otherwise disposed of, or changed into a usable form. The Secretary must report to Congress within 30 days after the end of the second and fourth fiscal quarters about property gifts received in the prior two quarters and must describe any items worth more than $1,000,000 (adding together similar items or parts that make up equipment or facilities). The Secretary may use donated property unless that use would break rules for a program. The Treasury may invest the account’s money in U.S. securities and return any interest to the account. The Secretary must tell Congress about any donor conditions, allow audits by the Comptroller General, treat devises and bequests as contributions, and write rules to run the program.
