The Defense Department can use its aeromedical evacuation planes to carry a veteran to or from a Department of Veterans Affairs (VA) medical center. The planes can also carry the remains of a veteran who died at that VA center. The remains may be taken back to the place the veteran came from or to another place that is no farther from the VA center. Such flights must follow an agreement between the Defense Department and the VA. The agreement must say the VA will notify and request the transport, there must be space on the aircraft, and there must be enough medical and service staff for everyone on board. Veterans or their survivors do not pay for these flights. The VA must pay the Defense Department for any extra costs it causes. A veteran must be a “primary beneficiary” as defined in 38 U.S.C. 8111(g)(5)(A). The word “veteran” has the meaning in 38 U.S.C. 101(2).
