A Secretary of a military department may give surplus real land to certain groups so the land is used for natural resource conservation. To be given away, the land must be under that Secretary’s control, useful for conservation, already offered enough time for public benefit claims, and not waiting to be transferred to another Federal agency or other qualified recipient under subtitle I of title 40. The land can go to a State or local government, or to a nonprofit whose main job is conserving natural resources. The deed must make the land stay used and cared for as conservation land forever, and the United States can take back the land if it is not. The recipient may be allowed to transfer the land to another eligible recipient with the Secretary’s approval and the same rules, and may run small compatible income activities on the land. The Secretary can add other protections in the deed. With the Interior Secretary’s agreement, a covenant can be released if the recipient pays the land’s fair market value at that time; the Secretary may reduce the payment to account for conservation value already provided. The Secretary cannot approve a reconveyance or covenant release until 14 days after sending an electronic notice to the appropriate committees of Congress under section 480. The transfer cannot be used to meet permitting conditions for defense work, may be used to start a mitigation bank only if not meant to satisfy permit requirements, must respect base-closure laws, and must offer Guam property first to the Government of Guam under section 1 of Public Law 106–504 (114 Stat. 2309). Appropriate committees, Secretary concerned, and State have the meanings given in the statute.
