Allows a military department Secretary, and the Secretary of Defense for Defense Agencies, to pay into pollutant-banking or water-quality trading programs when a authorized activity may or will release pollutants. The program must be approved under the Environmental Protection Agency’s Water Quality Trading Policy dated January 13, 2003, or any later related guidance or rule. Those payments can be treated as eligible costs for military construction projects. The term "discharge of pollutants" means what section 502(12) of the Federal Water Pollution Control Act (33 U.S.C. 1362(12)) defines.
