The head of a military department may make an advance payment of up to $100,000 to a person (or their legal representative) who is injured, killed, or whose property is damaged or lost when a claim could be allowed by law. These payments only cover amounts that would otherwise be payable under section 2733 or 2734 of title 10 or section 715 of title 32. The Secretary can let the Judge Advocate General make payments, and can let other officers make payments of $25,000 or less. Payments must follow department rules and, as far as possible, those rules should be the same across the military departments. Any advance payment will be taken out of any later award for the same injury, death, damage, or loss. Making a payment is not the United States admitting it is legally responsible for the accident.
