The Secretary of Defense can pick a civilian employee or service member and put that choice in writing, calling them a "departmental accountable official" who can be made to repay illegal, improper, or incorrect payments by the Department of Defense. The person chosen must be someone who gives information, data, or services that a certifying official directly relies on to approve payment vouchers, and who is not already legally responsible for those payments under subtitle III of title 31 or other law. The Secretary can require repayment if the bad payment happened because of the information that person gave and it was due to the person’s fault or negligence. Repayment rules are the same as for officials covered by subtitle III of title 31, and any repayment can be shared with other liable officials. "Certifying official" means the employee who has the duties listed in section 3528(a) of title 31.
