Title 10 › Subtitle A — General Military Law › PART IV — SERVICE, SUPPLY, AND PROPERTY › CHAPTER 169 — MILITARY CONSTRUCTION AND MILITARY FAMILY HOUSING › SUBCHAPTER I — MILITARY CONSTRUCTION › § 2814
Allows the Secretary of the Navy to sell, lease, or use Navy property in Hawaii to help develop Ford Island, as long as the development fits Navy missions. Before doing anything, the Secretary must send a master plan to the right Congressional committees and wait 30 calendar days. For each sale or lease, the Secretary must also send a detailed notice to those committees and wait 20 days. The Secretary may convey property that is excess to military needs or lease property not needed for current operations, if the deal helps the Ford Island plan. Recipients must be chosen through a competitive process. The Secretary must get at least the fair market value in cash, property, or services. Allowed services include building or improving facilities, restoring property, or providing property support services. Leases may give the lessee a first chance to buy the property if it is later sold. The Secretary can take a lease interest in facilities built under these rules for up to 10 years unless the Secretary of Defense approves a longer term, and the United States may keep a right of first refusal to buy back such facilities when a lease ends. Money from sales or leases and any money appropriated go into the Ford Island Improvement Account. Those funds, when Congress provides them, may be used for transactions under these rules, for improvements on Ford Island, or for property support services. The rules generally do not allow using these authorities to build family or unaccompanied military housing, but funds can be moved to the Defense housing improvement funds under existing rules. Some usual property management laws do not apply to these transactions. Budget scorekeeping rules still apply. Property support service: utility or other services that help operate and maintain property or facilities.
