A military department secretary may lease family housing in the National Capital Region (as defined in section 2674(f) of this title) to the Secretary of Defense. When picking a unit, the Secretary of Defense should first consider units already set up for executive communications and security. The lease must require payment equal to 105 percent of the monthly basic allowance for housing under section 403(b) of title 37 for an O‑10 with dependents at that installation, and that rate is the fair market value. All money from these leases must be put into a special Treasury account for that military department. The funds are available to the department secretary, without further appropriation, to pay for upkeep and improvements to military housing on the installation where the leased unit is located.
