The Secretary may sell or lease property or buildings (including supporting facilities) to eligible groups and use the money from that sale or lease to fund the program in this part of the law. Property on or near a base approved for closure under base closure law is not covered. The sale or lease terms must allow later resale or re-lease under fair, open competition that fits the value and type of the property. The Secretary can set prices and rules to protect U.S. interests. As part or all of the payment, the buyer or lessee must agree to give members of the armed forces and their dependents a suitable preference when renting a reasonable number of the housing units or other suitable housing made available. These sales or leases are not subject to certain federal property and procurement rules, including 10 U.S.C. 2667; parts of title 40 and parts of subtitle I of title 41 (except sections 3302, 3501(b), 3509, 3906, 4710, and 4711); 40 U.S.C. 1302; and 42 U.S.C. 11411. If the Secretary starts negotiating to extend a ground lease, the Secretary must notify the congressional defense committees in writing and give a briefing no later than 60 days after starting talks and again no later than 90 days before actually extending the lease. The notice must show major changes from the original lease (including new term length and important new provisions); how many units will be built, torn down, or renovated; any new financing sources for development; annual data for the last five years on debt-to-net operating income, occupancy rates, maintenance response and completion, and similar project stats for other housing projects run by the same company; and an assessment of the lessor’s compliance with the Military Housing Privatization Initiative Tenant Bill of Rights under 10 U.S.C. 2890.
