When a contract is made in a fiscal year to buy or build military family housing that will not be owned by the United States, the Secretary of Defense may move money from that service’s military housing funds into its pay and allowances account for the same year. The amount moved cannot be more than the extra basic allowance for housing (BAH) those members will get under section 403 of title 37 because they are assigned to those units. Any transfer can only happen if Congress has provided the money in an appropriations act.
