§3401 — Title 10 Armed Forces | U.S. Code

Summary

Defines two contract types used here. A delivery order contract is for buying goods that does not fix a set amount to be bought (it can set a minimum or maximum) and lets the buyer place delivery orders while the contract runs. A task order contract is the same idea for services: it does not fix a set amount of work (except a minimum or maximum) and lets the buyer issue task orders during the contract period.

In this chapter:

(1)The term “delivery order contract” means a contract for property—

(A)that does not procure or specify a firm quantity of property (other than a minimum or maximum quantity); and

(B)that provides for the issuance of orders for the delivery of property during the period of the contract.

(2)The term “task order contract” means a contract for services—

(A)that does not procure or specify a firm quantity of services (other than a minimum or maximum quantity); and

(B)that provides for the issuance of orders for the performance of tasks during the period of the contract.
