The Secretary of Defense must create one or more faster ways to buy, build, and deliver software and related hardware. At minimum, there must be an applications pathway for quickly building and fielding apps, cloud services, and other off-the-shelf items (and any needed covered hardware), and an embedded systems pathway for quickly updating software and hardware inside weapons and other unique DoD systems. These pathways must use proven tools and processes to keep improving and delivering capabilities. New software work must start fast, show it can be used in operations within one year after money is first spent, and be updated at least once a year. Each pathway must make requirements, budgets, and contracting simpler so fielding can happen within one year of starting. Pathways must collect data and keep talking with users while they build, test, and deliver capabilities. The pathways are generally exempt from the Joint Capabilities Integration and Development System Manual and from DoD Directive 5000.01 unless a modified process is used by the Vice Chairman of the Joint Chiefs of Staff or the Under Secretary of Defense for Acquisition and Sustainment in consultation with service acquisition executives. The Secretary must use a risk-based approach tied to needs from the Joint Chiefs of Staff and combatant commanders. Software and covered hardware bought this way are not treated as major defense acquisition programs unless designated by the Under Secretary for Acquisition and Sustainment or a service acquisition executive. Covered hardware = commercial or nondevelopmental products that have the embedded software. Nondevelopmental item = defined in title 41, section 110.
