Title 10 › Subtitle A — General Military Law › PART V — ACQUISITION › Subpart D — General Contracting Provisions › CHAPTER 281 — CLAIMS AND DISPUTES › § 3863
Money taken from a contractor because of a claim by a military department or Defense Agency must be kept available to pay either a settlement or any court or appeal judgment that finds for the contractor. While kept, the money can only be used for those specific payments. If no appeal to the Armed Services Board of Contract Appeals or court case starts in the set time, the money’s availability ends 180 days after the deadline to file in the U.S. Court of Federal Claims. If there is a settlement, the funds stay available for 180 days after the settlement. If there is a judgment for the contractor, the funds stay available for 180 days after that judgment is final. After the availability ends, the money is sent to the Treasury as miscellaneous receipts.
