The Secretary of Defense may hire students from colleges or universities, when money is available, for short or occasional technical work at defense research labs. Contracts can be made directly with students or with nonprofits that hire those students. Students hired this way are treated as employees only for work-injury benefits (chapter 81 of title 5) and for tort claims (chapter 171 of title 28). If they are not already federal workers, they are not federal employees for any other purpose. The Secretary must write rules to carry out this program and must define “student,” “institution of higher learning,” and “nonprofit organization.”
