The Administrator must make rules that require contractors and subcontractors to tell the Chief Information Officer when a covered network is breached. The Administrator will work with the Deputy Administrator for Defense Programs, the Associate Administrator for Acquisition and Project Management, the Chief Information Officer, and any other needed Administration officials to decide which networks are covered. Contractors and subcontractors must send a report to the Chief Information Officer no later than 60 days after they find a breach. The report must say how the breach happened, give a sample of any malware if they found and isolated it, and summarize any Administration program information that might have been affected. If they cannot get everything in 60 days, they must send what they have and give the rest as it becomes available. The Administrator must also set rules so Administration staff can, when needed, access contractor equipment or information for forensic checks to see if government data was taken, while protecting trade secrets, financial data, and personal identifiers, and limiting who gets the information to those with a need for response, law enforcement, counterintelligence, or national security. Chief Information Officer: the Associate Administrator for Information Management and Chief Information Officer of the Administration. Contractor: a private group that has a contract with the Administration to provide goods or services. Covered network: any network that holds classified material or sensitive unclassified information for an Administration program. Subcontractor: a private group hired by a contractor to support a contract for the Administration.
