Title 10 › Subtitle Subtitle A— General Military Law › Part II— PERSONNEL › Chapter 36— PROMOTION, SEPARATION, AND INVOLUNTARY RETIREMENT OF OFFICERS ON THE ACTIVE-DUTY LIST › Subchapter III— FAILURE OF SELECTION FOR PROMOTION AND RETIREMENT FOR YEARS OF SERVICE › § 634
Colonels in the Regular Army, Regular Air Force, Regular Marine Corps, and the Space Force, and captains in the Regular Navy who are not on promotion lists for brigadier general (or, for Navy captains, rear admiral (lower half)), must retire once they reach 30 years of active commissioned service. If they are not already retired, they must leave on the first day of the month after the month they hit 30 years. There are exceptions: the rule does not apply to certain Navy limited‑duty officers covered by section 8372(a)(4) and to Navy or Marine Corps officers who are permanent professors at the U.S. Naval Academy, and it also excludes cases covered under subsection (b) and sections 637(b) or 637a.
