Title 10 › Subtitle A — General Military Law › PART II — PERSONNEL › CHAPTER 36 — PROMOTION, SEPARATION, AND INVOLUNTARY RETIREMENT OF OFFICERS ON THE ACTIVE-DUTY LIST › SUBCHAPTER VI — ALTERNATIVE PROMOTION AUTHORITY FOR OFFICERS IN DESIGNATED COMPETITIVE CATEGORIES › § 649h
An officer who is facing discharge or retirement can be kept on active duty if a selection board under section 611(b) picks them and the service still needs them. The officer can only be kept for jobs the Secretary of that military department has named and that have or will have openings. Before the board meets, the Secretary must list those jobs. The board can only recommend officers who are fit for those jobs based on skills, knowledge, and behavior. The Secretary must approve any continuation. If an officer refuses the offer, they will be discharged or retired under section 632. An officer kept on active duty under this rule stays in the assigned job for up to three years from the date they start that job. They can be picked again before that time ends to continue longer. If not picked again, the officer will be discharged at the end of the period or retired under any other law they qualify for on the first day of the month after the month they finish. Any discharge or retirement under this rule counts as involuntary for other laws.
