If an officer was ordered to take leave that was charged as excess, and a board recommended removing them but the Secretary did not approve that removal, the officer must be treated as if they earned pay and allowances for each day of that required excess leave. Days the officer already got paid for under another rule are not counted. The officer will be paid that amount, minus any money they got during that time from wages, salaries, tips, other personal-service pay, unemployment, or public assistance from any government agency. The payment must be made within 60 days after the Secretary decides not to remove the officer. If the officer does not give needed income information when asked, the 60-day time limit is paused until 30 days after they provide the information. The military Secretaries must make uniform rules and may require tax returns or other documents to verify income.
