The Secretary of the Army can give some Army special agents the same power as agents under section 1585a to serve warrants and arrest people without a warrant. This covers Army Criminal Investigation Command agents who investigate Army programs. For the four-year period beginning on the date of the enactment of the National Defense Authorization Act for Fiscal Year 2025, it also covers Army Counterintelligence Command agents who handle counterintelligence investigations. Those powers must follow rules set by the Secretary of the Army and approved by the Secretary of Defense and the Attorney General.
