The Secretary of the Army may decide that money Congress gave the Army for a certain Academy sports or recreation program should be treated like nonappropriated funds. That money can then be spent under the rules for nonappropriated funds and will remain available until it is used. An "Academy mixed-funded athletic or recreational extracurricular program" is an Academy sports or recreation activity that (1) is not a morale, welfare, or recreation program, (2) is supported by appropriated funds, (3) also gets support from a nonappropriated fund instrumentality, and (4) is not a private organization and is not run by one.
