The Army Secretary, with the Secretary of State’s agreement, can provide goods and services at Kwajalein Atoll, including travel between atolls, to the Government of the Republic of the Marshall Islands and to other users the Army decides are eligible. The Army cannot provide these goods or services if the Secretary of State says doing so would conflict with the Compact of Free Association or any related agreement. The Army can charge the RMI government and eligible users for what it provides, but charges cannot be more than the United States’ actual costs. Army appropriations may pay necessary expenses for these services. The Army Secretary must create rules to run this program.
