If a commissioned officer who was removed by the President files a sworn written request saying the removal was wrong and asks for a court-martial, the President must order a general court-martial as soon as possible to try the officer on the same charges. The officer gives up the right to use any statute-of-limitations defense. The court can decide to keep the dismissal as part of the sentence, but if the officer is found not guilty or the final sentence does not include dismissal or death, the Secretary in charge must replace the dismissal with an administrative discharge. If the President does not order the court-martial within six months after the request, the Secretary must replace the dismissal with an administrative discharge. If a discharge is put in place, the President alone can reappoint the officer to the grade and rank the officer likely would have reached, without regard to vacancies, and the time between dismissal and reappointment counts as service for pay and benefits. An officer who was discharged administratively or dropped from the rolls by the President has no right to this court-martial.
