Certain military leaders can order summary courts-martial. That includes anyone who can order a general or special court-martial, commanders of detached Army companies, detached Air Force squadrons or similar Space Force units, and other commanders when the Secretary allows. If only one commissioned officer is with a command or detachment, that officer must act as the summary court-martial and decide cases. A higher authority may still order a summary court-martial if they think it is needed.
