The President must tell the Secretary of Defense, working with the department that oversees the Coast Guard when it is not part of the Navy, to create non-binding advice for commanders, convening authorities, and military lawyers on how to handle charges under sections 830 and 834 (articles 30 and 34) to protect justice and discipline. That advice must take into account the Attorney General’s guidance about fair, evenhanded handling of federal criminal cases while also considering military needs.
