Title 10 › Subtitle Subtitle A— General Military Law › Part II— PERSONNEL › Chapter 47— UNIFORM CODE OF MILITARY JUSTICE › Subchapter VI— PRE-TRIAL PROCEDURE › § 835
The prosecutor must give the accused a copy of the charges and the written details when the case is sent to trial. If the accused objects, a general court-martial cannot begin from the day the charges are delivered until the fifth day after that day, and a special court-martial cannot begin until the third day after. The objection must be made at the trial’s first session, and if that first meeting happens before the waiting period ends the judge must ask if the defense objects. This rule does not apply in time of war.
