The Secretary of the Navy may release any member of the Fleet Reserve or the Fleet Marine Corps Reserve from active duty at any time, unless the special rules in the next paragraph apply. If there is a war or a national emergency declared by Congress or by the President after January 1, 1953, a member can be put off active duty without their consent only if one of three things is true: the member asked for a board of officers to meet, that board recommends release, and the recommendation is approved; the member did not ask for a board; or another law specifically allows the release. This rule does not cover releases that are only for active duty for training.
