A court-martial that meets the rules below makes a service member lose pay and allowances while they are confined or on parole. The loss starts on the date set under section 857 (article 57) and can be delayed if that rule allows. A general court-martial causes loss of all pay and allowances. A special court-martial causes loss of two-thirds of pay. The rule applies when the sentence is confinement for more than six months or death, or confinement six months or less together with a dishonorable or bad-conduct discharge or dismissal. If the accused has dependents, the convening authority (or the person acting in that role under article 60a/60b) may waive some or all of the pay loss for up to six months. Any pay that would have been lost can be paid to the dependents as directed. If the sentence is later set aside, disapproved, or finally approved without the pay-loss punishment, the member must be paid the money they missed for the time the loss was in effect.
