If a court orders prize property sold, the marshal must prepare and send out full lists of the items and give a copy to the court. The marshal must also advertise the sale in posters and newspapers the court picks, tell the naval prize commissioner at least five days before the sale, and keep the goods open for people to inspect for at least three days before the sale. The Secretary of the Navy must hire an experienced auctioneer to run the sale. The auctioneer or the auctioneer’s agent must collect and deposit the total money from the sale and are responsible to the marshal for running the sale and handling the money.
