When a ship or other property taken by a hostile force is taken back by U.S. forces, a court must decide a fair salvage award. If the property belongs to the United States, it is returned to the U.S. and the court-ordered costs and expenses are paid from the Treasury. If the property belongs to a person under U.S. protection, the court returns it to the owner when the owner pays the salvage, costs, and expenses the court sets. If the owner is a permanent resident under a friendly foreign government and that government would return a U.S. citizen’s property in the same case, the court follows that government’s rules; if no rule is known, the owner must pay the salvage, costs, and expenses. All salvage awards go to the United States.
