The Department of Defense must not use its money for research that treats a person as an experimental subject unless the person gives informed consent in advance (meaning they agree after being told about the research). If the research is meant to help the person, consent can come from the person or a legal representative. The Secretary of Defense can make a one-time exception for a specific project to help develop a medical product needed by the military if the project may directly benefit the participant and follows all other laws. The Secretary may give that waiver power to the Under Secretary of Defense for Research and Engineering.
