Title 12 › CHAPTER 13 — NATIONAL HOUSING › SUBCHAPTER V — MISCELLANEOUS › § 1731b
Housing built with mortgages insured under this law must be used mainly as homes. It cannot be run as a hotel or short-term rental while the mortgage insurance is still in effect. Two old exceptions are allowed: if the Secretary agreed in writing by May 28, 1954 to let some units be rented as hotel or transient rooms, those agreed units may be used that way; or if the project is in a resort area and some units were already rented short-term before May 28, 1954, only that same number of units may continue. Mortgages insured before August 2, 1954 are treated under earlier commitments. New or renewed insured mortgages must have the borrower swear under oath they will not allow hotel or transient rentals while the insurance remains, and the Secretary may make agreements or buy stock to stop such uses if needed. The Secretary must investigate written complaints and order any illegal hotel or short-term rentals to stop right away. If they do not stop, the Secretary sends the case to the Attorney General for possible court action or prosecution. The Attorney General can ask a federal district court for injunctions without posting bond. Hotel owners within 50 miles can also ask a court to stop violations. Definitions: "rental for transient or hotel purposes" is set by the Secretary, and any rental under 30 days always counts; "multifamily housing" means certain properties with multiple homes or units (briefly described above).
